Terms of Service

1. Account Terms

• Authentication. Accounts are created and accessed via email-based passwordless authentication. You must provide a valid email address to use the service.
• One account per person. Each individual may maintain only one Guzz Labs account. Duplicate accounts may be merged or terminated.
• Account security. You are responsible for maintaining the security of your account and email address. Guzz Labs is not liable for any loss or damage resulting from unauthorized access to your account.
• Age requirement. You must be at least 18 years of age to create an account and use Guzz Labs services.

2. Subscription Plans & Credits

Guzz Labs offers four subscription tiers: Free, Starter, Pro, and Pro+. Each paid tier includes a monthly credit allowance for weather file generation and related data products. The Free tier includes 5 lifetime welcome credits that never expire.

• Credit model. Generation actions consume credits (typically 1 credit per single file, 2 per multi-file bundle, 10 per per-model ensemble). Unmodified TMY downloads and all read-only / analysis operations are free. See the pricing page for the current cost table.
• Billing. All paid subscriptions are billed monthly or annually through Stripe. You authorize recurring charges to your payment method on file. Annual subscriptions are discounted approximately 33% relative to monthly.
• Cancellation. You may cancel your subscription at any time through your account dashboard. Upon cancellation, your account reverts to the Free tier at the end of the current billing period. Monthly credits do not roll over; lifetime welcome credits remain.
• Refunds. Payments are non-refundable except where required by applicable law. Partial-month usage is not prorated upon cancellation.

3. API Usage

• Availability. API keys are available on all tiers (including Free). Generation endpoints consume credits per call; two public read endpoints (/stations and /guzzstations) work without authentication.
• Rate limits. API requests are subject to rate limits based on your subscription tier. Exceeding rate limits may result in temporary throttling.
• Confidentiality. API keys are confidential credentials. You are responsible for keeping your API keys secure and must not share them publicly or embed them in client-side code.
• Abuse. Abuse of the API, including circumventing rate limits or using keys for unauthorized purposes, may result in immediate key revocation and account termination. Guzz Labs may monitor API usage for compliance with these Terms.

4. Acceptable Use

You agree not to engage in any of the following prohibited activities:

• Unauthorized scraping, crawling, or automated extraction of data outside of the provided API
• Redistribution of raw or bulk weather file datasets as a standalone data product
• Attempting to reverse engineer or replicate proprietary processing pipelines or methodologies
• Automated bulk access outside of the provided API or without a valid API key
• Reselling downloaded weather files as part of a competing weather file generation service

5. Weather File Disclaimer

Weather files generated by Guzz Labs tools are intended for professional building energy simulation use, including energy modeling, HVAC sizing, and climate risk assessment. Guzz Labs provides tools and data products — not engineering advice.

Users are responsible for validating simulation results against local building codes, ASHRAE standards, and project-specific requirements. Guzz Labs does not guarantee the accuracy of weather files for critical design decisions and recommends cross-referencing with primary data sources where appropriate.

Guzz Labs tools are intended for use by professionals in building energy modeling and related fields. Users should have appropriate domain knowledge when interpreting results. Use of Guzz Labs services does not create any professional services relationship, including but not limited to engineering, consulting, or advisory services.

7. Intellectual Property

EPWForge, Guzz Labs, and all related tools, interfaces, and branding are proprietary to Guzz Labs. The morphing methodology, GuzzWeather database, extreme events database, and associated processing pipelines are proprietary intellectual property.

Users retain full ownership of weather files and data products they download through Guzz Labs services. Downloaded files may be used freely in your projects without attribution, subject to the acceptable use restrictions in Section 4. Guzz Labs retains all rights to the underlying platform, processing methods, and data systems used to generate such files.

8. Limitation of Liability

Guzz Labs services and data products are provided “as is” and “as available” without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. To the fullest extent permitted by law, Guzz Labs shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from the use of weather files or data products in design decisions, energy modeling, or any other application.

9. Service Availability

Guzz Labs does not guarantee uninterrupted or error-free service. Access may be suspended or restricted for maintenance, updates, or unforeseen issues. Guzz Labs is not liable for any damages arising from service interruptions or downtime.

10. Termination

Guzz Labs reserves the right to suspend or terminate accounts at any time for violation of these Terms or misuse of the service. Upon termination, your access to paid features and API keys will be revoked immediately. Any data associated with your account may be deleted after a reasonable retention period, as determined by Guzz Labs.

11. Privacy

Use of Guzz Labs services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Massachusetts, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located within Massachusetts.

13. Changes to Terms

Guzz Labs reserves the right to update these Terms of Service at any time. For material changes, we will notify registered users via email prior to the changes taking effect. Continued use of the service after changes constitutes acceptance of the revised terms.

14. Entire Agreement

These Terms constitute the entire agreement between you and Guzz Labs regarding use of the service and supersede any prior agreements or understandings, whether written or oral.
